2. Acceptance; Scope

By installing, accessing, or using the Game you accept and agree to these Terms and our Privacy Policy available at: Privacy Policy. If you do not agree, do not install or use the Game.

These Terms apply to all versions of the Game distributed by Novinity (including Steam and older Google Play builds). Platform-specific store rules (for example Steam Subscriber Agreement and Google Play Terms) may also apply and, where applicable, take precedence with respect to purchases made through those stores.

3. Eligibility

The Game is made available to all ages. If you are a minor under the age required by local law to form a binding contract, you must have the consent of a parent or legal guardian to accept these Terms. Novinity expressly recommends that minors obtain parental permission prior to making any purchases.

4. Account, Platform Access and Authentication

Where the Game integrates with a third-party platform (for example Steam), access to certain features and purchases requires a valid account with that platform. You are responsible for maintaining the confidentiality of any credentials and for all activity that occurs under your account. Novinity is not responsible for access issues caused by the platform or third-party account services.

5. License Grant and Ownership

Subject to these Terms and any platform rules, Novinity grants you a limited, non-exclusive, non-transferable, revocable license to install and use the Game on supported devices for personal, non-commercial entertainment. All rights, title and interest in and to the Game (including code, artwork, audio, text and documentation) remain the sole property of Novinity or its licensors. No ownership of Novinity’s intellectual property is transferred to you.

6. Purchases, DLC, Virtual Items and Refunds

The Game is free-to-play. Certain optional Supporter DLC providing cosmetic items may be offered for purchase. Purchases made on Steam are processed through Steam and are subject to Steam’s payment, billing and refund policies. Novinity does not directly process refunds for Steam purchases; refund requests must be made through the platform in accordance with the platform’s refund procedures.

There are no in-game microtransactions other than the Supporter DLC described above. Virtual currency within the Game is earned via gameplay.

All Virtual Items and Virtual Currency are licensed, not sold. Novinity reserves the right to modify, remove, or revoke Virtual Items or Virtual Currency at its discretion, subject to applicable law. Where the Game does not rely on Novinity-run servers (see Section 12), items and progress are stored locally or on platform-managed services.

7. No Servers / Server Shutdown

The Game currently does not require Novinity-hosted servers to operate. If this status changes in the future and the Game relies on Novinity-hosted servers, Novinity will provide reasonable notice regarding any planned shutdown and will publish applicable terms for treatment of purchases and account data at that time.

8. Conduct; Prohibited Uses; Enforcement

You agree not to: (a) reverse engineer, decompile, or otherwise attempt to derive source code from the Game except as expressly permitted by law; (b) cheat, exploit, manipulate, or interfere with the Game experience for other players; (c) use the Game for unlawful activities; or (d) use the Game to distribute malicious software. Novinity does not currently operate anti-cheat software; however, Novinity reserves the right to investigate apparent cheating, exploitation, or other prohibited conduct and to suspend, terminate, or take other remedial action against accounts or copies of the Game involved in such conduct.

9. User-Generated Content

The Game does not provide features for user-generated content at this time. If UGC features are added later, additional terms and rules will be provided and posted.

10. Third-Party Services and SDKs

The Game may integrate third-party software and services (for example Steamworks.NET). Third-party service providers may collect data or provide services subject to their own terms and privacy policies. See our Privacy Policy for details about data collection and third-party processing.

11. Privacy and Data

Novinity’s collection, use and disclosure of personal information is governed by the Privacy Policy available at: https://www.novinitygames.com/games/stair-tap/privacy-policy. By using the Game you acknowledge that you have read and accepted the Privacy Policy.

12. Updates, Patches and Access

Novinity may provide updates, patches, upgrades and modifications to the Game. You agree that Novinity may automatically download and install such updates. Novinity is not obligated to provide updates or to continue to support any particular version of the Game.

13. Intellectual Property Complaints (DMCA / Copyright)

If you believe content in the Game infringes your copyright, please submit a written notice containing the elements required by applicable law to:

Notices should contain the information required by the applicable law for takedown notices (for example, the DMCA requires a signature, identification of the copyrighted work, identification of the allegedly infringing material, contact information, and a statement of good faith belief).

14. Warranties; Disclaimers

To the fullest extent permitted by law, the Game and all content are provided “AS IS" and “AS AVAILABLE" without warranties of any kind, express or implied. Novinity expressly disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation. Some jurisdictions do not allow the exclusion of implied warranties; where such laws apply, the foregoing exclusions may not apply to you.

15. Limitation of Liability

To the maximum extent permitted by applicable law, in no event will Novinity, its officers, employees, agents or licensors be liable for any indirect, incidental, special, consequential or punitive damages (including loss of profits, loss of data, loss of goodwill, or business interruption) arising out of or relating to these Terms or your use of the Game, even if Novinity has been advised of the possibility of such damages. Where liability cannot be excluded under applicable law, Novinity’s total aggregate liability for direct damages arising out of or relating to these Terms or the Game shall not exceed the greater of (a) AUD $100, or (b) the total amount you actually paid to Novinity for the Game and/or Supporter DLC during the preceding twelve (12) months. Consumer rights under applicable consumer protection laws (including statutory warranties that cannot be excluded) remain unaffected.

16. Indemnification

You agree to indemnify, defend and hold harmless Novinity and its affiliates, officers, directors, employees and agents from and against any claims, liabilities, damages, losses and expenses (including reasonable legal fees) arising from or related to: (a) your breach of these Terms; (b) your use of the Game; or (c) your violation of any rights of a third party.

17. Termination and Suspension

Novinity may suspend or terminate your access to the Game or any portion thereof at any time, with or without cause, including for breach of these Terms. Upon termination, the licenses granted herein will immediately terminate and you must cease all use of the Game. Termination will not relieve you of obligations incurred prior to termination. Any virtual items or progress may be inaccessible following termination; refunds (if any) will be subject to platform rules and applicable law.

18. Changes to Terms

Novinity may modify these Terms from time to time. Material changes will be posted and the effective date above will be updated. Continued use of the Game after changes are posted constitutes acceptance of the revised Terms. Where required by applicable law or platform rules, Novinity will attempt to provide notice (for example via the platform or by email to the address associated with your account).

19. Governing Law; Dispute Resolution

These Terms are governed by the laws of Australia, without regard to conflict of law rules. To the extent permitted by law, you and Novinity submit to the non-exclusive jurisdiction of the courts of Australia to resolve disputes. Nothing in this Section limits Novinity’s right to seek injunctive or other equitable relief in any jurisdiction.

20. Export Controls and Compliance

You agree to comply with all applicable export and import laws and regulations and not to export or re-export the Game to any country or person prohibited by applicable law.

21. Miscellaneous

• Severability: If a court finds any provision of these Terms invalid or unenforceable, the remainder will remain in full force.
• Entire Agreement: These Terms and the Privacy Policy constitute the entire agreement between you and Novinity concerning the Game and supersede prior agreements.
• Assignment: Novinity may assign its rights under these Terms to a successor or affiliate. You may not assign your rights without Novinity’s prior written consent.
• No Waiver: Novinity’s failure to enforce any right is not a waiver of that right.
